Sad day at FLOYD LAMB STATE PARK

Took my son fishing at floyd lamb park today. The fishing was slow but not the Sad part. While watching my rod I observe a game warden checking people for their licenses. He checks two bozos and I overhear them say "didn't know I needed a lic to fish urban ponds" the warden begins to educate them on the regs. To my surprise he lets them go without a ticket and told them to cruise up to walmart and get a lic. He comes over to me friendly as can be asks for my lic. I hand it over wondering if it even mattered. I didn't have the balls to question him why he did what he did. The whole thing just made upset thinking do they do this to all poachers?

LE have discretion on how to handle a majority of violations. Part of the Job is to educate. Citations are not always the best answer. But in LE they always make somebody mad.

Thats sucks thats why I tend to stray away from the neighborhood ponds. If I was the warden thats a automatic ticket no ? asked but like Cacoon said its up to the warden on duty[:/]

No different than if you are pulled over for speeding, you were breaking the law, but are you upset if the officer let's you off with a warning? He gave you a friendly reminder to slow down and hopefully you learned from it, same with the fishermen. My .02

i say HANG THEM!!!! the NDOW didn't give me a break when we really didn't understand the 5 a day 10 posession rule at Sunny Side.

I loved paying that 230 fine. It amazed me the next years rule book totally made it clear.

I am joking, but i am amazed there was actually a Game Warden that gave a break to someone who possibly really didn't know they needed a license.

One time I was fishing right after the season change, and I put the wrong license back into my wallet. Got busted, $300 ticket, had to go to court and show my proper license to get off the hook. I was nice as hell too, but he wouldn't cut me a break for slipping up.

it amazes me how the people who really are legit and not in the wrong get the hammer put down on them when they really are not in the wrong.

My neighbor gave the DOW Ranger his non-res license California instead of his NV one and before he could say opps here's the right one....BUSTED.

Months and snail-mail it was dropped and no court date ever happened.

The whole time ive been in NV (3years) I never been checked anywhere the ponds or lakes which is actually a surprise to me since the state I came from the F&G was always out in force.

The only encounter I had was when I first moved here I took my atv down to 33 hole took it down the hill explored some fishing spots for a couple hours came back up to the parking lot to leave and there was a ranger parked right in front of my trailor with lights on you bet I got a ticket even though theres no signs posted.

I hear ya 4pound, I've been here all my life and could make a similar statement, but I won't [Wink] because I'm superstitious.

I think NDOW should step up enforcement. Perhaps the park fee increases wouldn't be necessary if everyone who fished paid for their license?

As far as letting people off with a warning, I say fine them. I just buy my $30 license rather than risking a $300 fine. The DOW needs revenue, and if they start hammering people for fishing without a license, people will buy there licenses instead. That would increasing revenue on both ends.

I'd say that just about 99% of anyone who says they didn't know they need a license is feigning ignorance. It's almost as dumb as saying you didn't think you'd need a license to drive a car. It's common knowledge IMO.

And as a police officer once explained to me, ignorance of the law doesn't preclude you from having to follow it.

If I recall correctly, there are limit signs posted all around each pond and each sign has a statement on it that says a valid state fishing license is required. They are large and posted at regular intervals. Claiming ignorance at Floyd is just flat out dishonest in my humble opinion and warrants an automatic ticket.

I don't always buy them all at once either, you can add the options to your license after the initial purchase.

Resident Annual License $29
Trout Stamp $10
Second Rod Stamp $10
AZ Reciprocal Stamp $ 3

I wouldn't mind if checked by a warden because I buy the annual, 2nd rod stamp, trout stamp, Co river stamp. I would take the opportunity to discuss with him some ?'s and concerns I have.

And ofcourse NDOW should step up enforcement as should any other states DOW. But the "problem" hasn't become big enough for anybody to care. Yeah so what a guy here and there doesn't have a lic. or is over harvesting. They also have to watch hunters most of the year so the time checking anglers is not cost effective. Also if its not a "stocked" fish or on the endangered list they could care less.

What do mean park fee increases wouldn't be necessary if everyone paid for a fishing license? The national park service is not related to NDOW.

Yes 4pound, you are correct. The park service and dow are separate gov't agencies so that wasn't a valid point, although you might understand the spirit of what I meant.

All I'm trying to say is people should buy their licenses.
