I'm no lawyer but if he was videoing you that's one thing, if he's recording audio, say you are on a phone call or talking with someone else, that may not be legal. I'd look into that in case that happens again. I'd be sure to be on the phone or talking with someone other than the guy recording the audio if it is indeed illegal. That is plain strange that someone would be videoing you for no reason.
