However, I don't have much hope that the legislature is going to do the right thing and repeal HB141 anytime soon. They are notorious for ignoring their constituents concerns if the constituent isn't connected to some large lobbyist group. Legal facts mean nothing to them.[/#800000][/font]

No one thinks the legislature will repel HB 141, Bob, as you said, they don't care about their constituents.
What we think will happen is that the Utah Supreme Court will rule that HB 141 is unconstitutional, there-by striking the law down. This will return Utah to pre-141 rule, basically Conatser's ruling. The fight won't end though, this ruling and the many to come, establish that the ground beneath the high-water mark is public land, not private. The ruling of navigability means that the land was never private and has been public since Utah became a state. There will be nothing the state legislature can do to negate that, nothing. Once the land is public land being held in trust by the state for the public, it becomes really hard to sell. These are not School Trust lands that are designated to support anything, they are state land held in trust for the public to use. It would take a change in the Utah Constitution to do anything to change these rulings, and I don't think there is the stomach or the votes for that. [signature] |
